Music made individually for you: a single song or a whole album, with lyrics written personally, professional production, matching cover art and, if you wish, release on streaming platforms. Every commission is one of a kind and is created to your brief.
You write and tell me what it is about. That is not yet an order and costs nothing.
After a conversation you receive a written offer covering scope, price and timeframe.
The contract is formed when you accept this offer in text form, for example by email. Only then does the work begin.
The contract text is not stored separately. You have the offer and the acceptance in your email inbox. The contract language is German.
The price stated in the offer applies. For orientation: a single song from 500 euros, an album with eight to twelve tracks between 2,000 and 5,000 euros.
Value added tax is not shown, as I am a small business under § 19 UStG. The amount stated is the final amount. Payment by bank transfer against invoice, due within 14 days unless the offer states otherwise. The costs for the streaming release are included.
As a rule two to four weeks from briefing to finished recording. Where there is a release on streaming platforms, the distributor's processing time is added, over which I have no influence. A fixed date applies only if it is expressly promised in the offer.
On full payment you receive a simple right of use, unlimited in time and territory, for the purpose named in the offer, for example a club celebration, internal use, your own website and social media channels. For wider commercial use, such as advertising or broadcast, we agree an extended licence.
The copyright in the lyrics and the composition remains with me. I may name and publish the song as a reference, unless the offer provides otherwise.
Consumers, meaning natural persons placing the order for private purposes, generally have a right of withdrawal in distance contracts. Clubs, companies and other clients acting commercially or in a self-employed capacity are not consumers; this section does not apply to them.
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal you must inform me (Lars Hüsemann, Auf dem Kamp 15a, 32694 Dörentrup, Germany, music@elaitsch.com) of your decision by means of a clear statement, for example by letter or email. You may use the model form below, but you are not required to. To meet the deadline it is sufficient that you send your notification before the period expires.
Consequences of withdrawal. If you withdraw from this contract, I shall repay to you all payments received from you without undue delay and at the latest within fourteen days from the day on which your notice of withdrawal reached me. For the repayment I use the same means of payment as in the original transaction; no fees are charged for this.
If you have expressly requested that I begin work before the withdrawal period expires, you owe me a reasonable amount for the work performed up to that point in the event of withdrawal.
There is no right of withdrawal in the case of contracts for the supply of goods or services made to your specifications or clearly tailored to your personal requirements (§ 312g (2) no. 1 BGB). A song written and produced specifically for your occasion is exactly that. I point this out expressly in the offer and only begin production once you have agreed.
If you wish to withdraw from the contract, you can fill in this form and send it back. You are not obliged to.
